Who can use BidCoat

BidCoat is for painting businesses and the people who bid for them. You must be at least 18 and use BidCoat for your business. If you use it for a company, you accept these terms for that company.

The app itself is licensed to you under Apple's standard Licensed Application End User License Agreement. These terms add what's specific to BidCoat. Lawyer: confirm how these terms and Apple's EULA fit together.

Your account

• You can use BidCoat without an account. You need one to send proposals as a link your client signs online.
• Several phones can share one account, for example the owner's and an estimator's. You're responsible for everything done with your account, so keep access to it, and to its email or Apple Account, secure.
• Tell us at support@bidcoat.app if you think someone else is using it.

Subscription and free trial

• BidCoat Pro costs $299.99 a year, with a 7-day free trial, or $39.99 a month (US prices; in other countries Apple shows the price in your currency).
• Apple bills it through your Apple Account. It renews automatically unless you cancel at least 24 hours before the end of the period.
• The free trial is free. Cancel before it ends and you pay nothing. Apple decides who can have a trial.
• Cancel any time on your iPhone: Settings → your name → Subscriptions → BidCoat. You keep Pro until the end of the period you've paid for. Refunds are Apple's decision, under Apple's rules (reportaproblem.apple.com).
• Without a subscription, some features stop working, such as starting new jobs. Your jobs and PDFs stay on your phone, and links you've sent keep working while your account exists.
• One subscription covers every phone signed in to the same BidCoat account.

Our price lock

Your price never goes up while you stay subscribed. If we raise prices, you keep paying the price you signed up at for as long as your subscription renews without a break. If it ends and you subscribe again later, the price at that time applies.

Taxes, and the prices Apple sets for other countries and currencies, can change what Apple charges you. We don't raise our price for you. Lawyer and owner: confirm this wording against App Store Connect's price-preservation settings.

The founding painter offer

• Founding painters pay $199.99 a year for life, meaning for as long as that subscription renews without a break, under the price lock above.
• It's for the first 100 painters who enter a founding code from one of our partner communities or creators. It isn't offered in ads.
• One code per account. Codes are entered only in the app, have no cash value, and aren't for resale or public posting. We can refuse a code that has been shared publicly.
• After you enter a code, your place is held for 7 days while you subscribe to the founding plan. If the purchase doesn't show up in that time, the place goes back to the pool.
• The founding plan is a separate subscription. If you're already on a trial or another plan, cancel that first, so Apple doesn't bill you for both: the app shows you how. We can't cancel an Apple subscription for you.

BidCoat is a tool: your prices, your contracts

• You set the price. BidCoat calculates from your measurements, your rates and your choices, and shows its math. Scans and typed measurements can be wrong. Check every estimate before you send it.
• You're responsible for your estimates, proposals and contracts, and for following the laws that apply to your business: licensing and registration, home improvement contract rules, the client's right to cancel, deposit limits, lead-safe work rules, taxes, and anything else.
• BidCoat's proposal wording and notices are templates, not legal advice. They may not fit your state, your job or your business. Check them, and change them in Setup where you need to.
• We're not a party to any contract between you and your client. Disputes about the work, the price or payment are between you and your client.

Deposits and payments

BidCoat never processes, holds or checks payments. Your client pays you directly, through the payment method you choose (for example PayPal, Venmo, Cash App, Zelle, or a Square or Stripe link). That service's terms and fees apply. BidCoat never takes a cut of your deposits. You confirm in the app when a deposit has been paid.

Your content and your clients' details

• You own what you put into BidCoat. You let us store, show and send it as needed to run BidCoat for you: for example, to host your proposal page, email the signed copy, and send the reminders you turn on.
• You confirm that you may give us your clients' details for this, and that you'll use them only for the job they asked you to bid.
• A proposal sent as a link is stored exactly as sent and can't be edited, so it can serve as the record of what your client saw and signed. It's deleted when you delete your account, except a signed one, which is kept 7 years after signing so you and your client can both show what was agreed.
• Your client can ask for a paper copy, decline, or stop reminder emails at any time.

Acceptable use

Don't use BidCoat to:

• break the law, or deceive or mislead anyone, including with false prices, credentials or signatures;
• send messages people didn't ask for, or send proposal links for anything other than your own real bids;
• pretend to be someone else, or use someone's details without the right to;
• get into accounts or data that aren't yours, test or break our security, or overload, copy or scrape the service;
• post or sell founding codes publicly.

The service

• Measuring, pricing and making PDFs work on your phone with no signal. Links, signing and emails need our servers and the services that help us run them, and may sometimes be unavailable.
• We improve BidCoat all the time, and may change or remove features. If a change takes away something important you pay for, we'll tell you in advance.
• We may suspend or close an account that breaks these terms or puts others at risk, and tell you why where we can. You can stop using BidCoat and delete your account at any time.

Warranties and liability

• BidCoat is provided as it is. We work hard to make its measurements and math right, but we don't promise that they're error-free, that the service will always be available, or that a proposal will win a job.
• As far as the law allows, we're not liable for lost profits, lost jobs, underbids, or indirect or consequential losses, and our total liability to you is limited to what you paid for BidCoat in the 12 months before the claim.
• Nothing in these terms limits rights that the law says can't be limited.

Governing law and disputes

Lawyer: governing law, courts or arbitration, and any US consumer carve-outs. Before bringing a claim, please write to us: most problems can be solved by email.

Changes to these terms

When we change these terms, we update the date at the top. If a change matters, we'll email you before it takes effect. Using BidCoat after that means you accept the new terms; if you don't, you can cancel your subscription and delete your account.
